1) Collected Information.

Unique Card Services™ collects several types of information from and about users of the Web Site. Generally, this information falls into two categories: "Personally Identifiable Information" and "Non-Personally Identifiable Information."

Personally Identifiable Information

For the purposes of this Policy, "Personally Identifiable Information" means information identifying a particular individual, such as an individual's name, postal address, e-mail address, and phone number. Personally Identifiable Information does not include Non-Personally Identifiable Information as defined herein. Unique Card Services™ may collect Non-Personally Identifiable Information about you through a variety of technical methods, including the following:

  • Collection of Usage Details and IP Address. As you navigate through the Web Site, Unique Card Services™ may collect details of your visits, including without limitation traffic data, location data, logs, accessed resources, and information about your computer and internet connection, including your IP address, operating system and browser type. Information collected by this means shall be used for system administration and to report aggregate information to our business partners.

Unique Card Services™ may use web beacons to compile information regarding your use of the Web Site.

The information collected through these technical methods, standing alone, cannot be used to determine your identity. Such information may, however, be combined in a way that makes it become Personally Identifiable Information. If this happens, Unique Card Services™ will treat the combined information as Personally Identifiable Information.

User Generated Content

You are responsible for any content, including Personally Identifiable Information, that you contribute to be published or displayed ("posted") on the Web Site, or that you transmit to other users of the Web Site (collectively, "User Generated Content"). Your User Generated Content is posted on and transmitted to other users of this Site at your own risk. Unique Card Services™ cannot control the actions of the Web Site’s other users with whom you may choose to share your User Generated Content. Unique Card Services™ is also not responsible for circumvention of any privacy settings or security measures contained on the Sites. As a result, we cannot and do not guarantee that your User Generated Content will not be viewed by unauthorized persons. 2) Use of Data Collected.

We use all information, including your Personally Identifiable Information, to enhance your experience with Unique Card Services™ and to enable us to present content we think might interest you. We use your contact information to send you information about our company and promotional material from our partners. We may also use your information, including any Personally Identifiable Information, to improve our web site, for statistical analysis, for marketing and promotional purposes, for editorial or statistical analysis, for marketing and promotional purposes, and for editorial or feedback purposes for our advertisers. Information collected by us may be added to our databases and used for future e-mails or postal mailings regarding site updates, new products and services, upcoming events, and/or status of orders placed online.

We will use your billing account information to bill you for your purchases, and we may share your billing account information with third parties for the sole purpose of effectuating any transactions that you enter into through Unique Card Services™ Shopping Club. In addition, by submitting your billing account information to us, you authorize Unique Card Services™ to periodically verify that your billing account continues to be a valid and active one by charging and, thereafter immediately crediting, a small sum to your account. Such verification may be conducted through a third party service provider and, in that case, Unique Card Services™ will share your specific billing account information with this third party for verification purposes. Apart from the foregoing uses, Unique Card Services™ reserves the right to share with other third parties the fact that we have billing account information on file for specific individuals, but we will not share the actual billing account information with other third parties without the applicable individual's prior informed consent.

In addition, you agree that by submitting your Personally Identifiable Information at the Web Site, such act constitutes a purchase, an inquiry and/or an application for purposes of the Amended Telemarketing Sales Rule, 16 CFR §310 et seq. (the "ATSR"). Notwithstanding that your telephone number may be listed on the Federal Trade Commission's Do-Not-Call List, we retain the right to contact you via telemarketing in accordance with the ATSR. However, your email address will only be shared with our mailing partner for the purpose of sending you relevant third party promotional offers. By submitting Personally Identifiable Information through this Web Site, you agree to allow us to share such information with third parties.

4) Your Opt-Out Rights.

You may opt-out of receiving communications from us and or our partners by not submitting your Personally Identifiable Information. We also allow you to remove your Personally Identifiable Information from our database. If you remove your Personally Identifiable Information from our database, it will no longer be used by us for secondary purposes, disclosed to third parties, or used by us to send promotional correspondences to you. 5) Your Rights to Your Personal Data.

Upon request via postal mail or e-mail, we will provide you a summary of your Personally Identifiable Information retained by us. We will only send your personal records to your e-mail address or postal address we have on file for you. 6) We do not Intend to Collect Data from Children.

The information and services provided by us or our affiliates, sponsors, and advertisers are not intended to be viewed by children (defined by the Children's Online Privacy Protection Act of 1998 ("COPPA") and its accompanying FTC regulations as individuals under the age of 13). We do not knowingly or intentionally collect Personally Identifiable Information online from children, and we instruct all users under the age of 13 to not send us any information for collection on the Sites, including their names, addresses, telephone numbers or e-mail addresses. 9) Third-Party Web Sites.

In certain circumstances, Unique Card Services™ acts as a limited agent for the actual seller of the products and/or services available for purchase at or through the Web Site. In these circumstances: 1) you will be redirected to the applicable seller's website after you have completed the application page; 2) Unique Card Services™ will collect and send your personal information to the respective seller in connection with completing your purchase from the seller; and 3) your purchase will subject you to the seller's privacy policy.

Unique Card Services™ does not endorse, nor is Unique Card Services™ responsible for the accuracy of, the privacy policies and/or terms and conditions of each of the third party sellers or advertisers that appear through this Web Site. The entities that sell, advertise and/or place banner ads at this Website including are independent third parties and are not affiliated with Unique Card Services™.

10) Users Located Outside of Pennsylvania.

The Web Site is operated in the United States and designed for users from the United States. Users located in the European Union, Canada and other countries are advised that any information you provide to Unique Card Services™ will be transferred to the United States. Accordingly, users outside the United States are advised not to disclose any information to Unique Card Services™ unless they consent to having their information transferred to the United States and used as set forth in this Policy rather than under the law of the user’s home country. If you are a California resident and you have provided Unique Card Services™ with your Personally Identifiable Information, you have the right to request one Notice of Information-Sharing Disclosure per year which will identify the third parties, if any, with whom Unique Card Services™ has shared your Personally Identifiable Information for direct marketing purposes. Your Notice Information-Sharing Disclosure request must include the reference "Request for California Privacy Information" on the subject line and in the body of the message and must include the e-mail address or mailing address, as applicable, for us to send our response. Absent extraordinary circumstances, our response to your Notice of Information-Sharing Disclosure request will be made within thirty (30) days of receipt. We reserve the right not to respond to requests submitted other than to the addresses specified in this paragraph.

12) Disputes.
